Terms and Conditions

PREAMBLE

The website https://lenfantin.com/ (hereinafter "the Site"), on behalf of the company L’ENFANTIN, a Simplified Single-Person Joint Stock Company with a capital of €1,000, whose registered office is L’ENFANTIN 25 Rue de l'Exposition 75007 Paris, registered with the Paris Trade and Companies Register under no. 909 942 831 and SIREN number: 909942831.

These General Terms and Conditions of Sale are intended to define the rules applicable to the sale of L’ENFANTIN products (hereinafter "the Product(s)") on the Site,

And

Any adult natural person, not acting as a trader, having the legal capacity to contract, exclusively domiciled in the countries delivered by https://lenfantin.com/ (hereinafter "the Customer") making a Product purchase on the Site.

For the purposes of these terms, it is agreed that the Customer will be individually referred to as the "Party".

These general conditions (hereinafter the "General Terms and Conditions of Sale") govern without restriction the sales of Products carried out by L’ENFANTIN from the Site.

L’ENFANTIN reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those in force on the Site on the date the Customer places the order; it being specified that any order for a Product offered on the Site implies the full and unreserved adherence of the Customer to the General Terms and Conditions of Sale in force at the time of placing their order.

ARTICLE 1 • PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the conditions under which the Products are sold by L’ENFANTIN to the Customer. They thus regulate the various stages of the sale, from the placing of the order by the Customer.

ARTICLE 2 • PRODUCTS

The Products offered for sale by L’ENFANTIN are those listed on the Site on the day of its consultation by the Customer. Each Product will be subject to a descriptive sheet which, in addition to the photograph, will contain: the price, the photograph, the available sizes and colors, the composition, as well as specific characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen.

L’ENFANTIN undertakes to deliver Products that comply with the regulations in force relating to the safety and health of individuals in accordance with European provisions, and in particular with the legislation on regulated chemical substances.

ARTICLE 3 • PRICE

Prices are indicated in euros, all taxes included, excluding delivery costs; it being specified that the value added tax is that in force in mainland France on the day of order validation.

The prices applied are those communicated on the Site and confirmed to the Customer when validating the order.

Delivery costs are communicated to the Customer on the order summary before its validation and are expressed inclusive of all taxes. These costs are borne by the Customer and are charged in addition to the selling price of the Products.

The transfer of risks of loss and deterioration of the Products will take place after delivery and receipt of the Products by the Customer.

We reserve the right to modify our prices at any time but we undertake to apply the prices indicated on the Site at the time of your order.

We inform you that in case of displaying an erroneous price, obviously derisory (ridiculous price), whatever the reason (computer bug, manual error, technical error.), the order - even validated by us - will be canceled, which we will inform you of as soon as possible. You will then be able, if you wish, to place your order again at the corrected and exact price.

ARTICLE 4 • ORDER AND PAYMENT OF PRODUCTS

  • 1 Placing an order

The Customer places their order by completing the following 5 steps

Step 1: the Customer selects the chosen Products and adds them to their cart after selecting the desired size and color.

The cart located at the top right of the screen informs the Customer that it has taken into account the selections by indicating the number of Products it contains.

Step 2: the Customer checks the content of their cart by clicking on "order" to access the summary of their order. The Customer can then modify their order (Product, size, quantity).

The total price of the order including all taxes, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.

Step 3: once the order has been checked and, if necessary, modified, the Customer validates their cart to finalize their order by clicking again on "order".

If the Customer has a discount code, they must enter it in the dedicated field to benefit from it.

Step 4: Customer enters delivery and billing details

Except for the date of birth, additional address information, and delivery details, all fields are necessary to finalize the order; it being specified that unless otherwise indicated by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, they have a customer account. In such a case, they will identify themselves only with their email address and password.

The Customer then checks all the information and clicks on "validate" to continue their order.

Step 5: Entering bank details

The Customer will then access the secure payment screen of L’ENFANTIN’s partner, as specified in Article 4.3 below.

Payment is made online by credit card only.

The Customer must enter their credit card number, its expiry date, and the 3-digit security code on the back of their card, it being specified that in case of payment by American Express card, the Customer must provide 4 digits.

If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

In case of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. After the 3rd refusal, the Customer will be redirected to the Site to a screen informing them of the payment refusal. The Customer will then be invited to contact customer service to find out the reasons and together find a solution to finalize the Customer's order.

  • 2 Order confirmation

Upon acceptance of the Customer's payment, the Customer will receive an email confirming their order, summarizing all the ordered items, the billing and delivery address, and the delivery date.

The validation of the order by the Customer and the order confirmation sent to the Customer by email by L’ENFANTIN following the acceptance of payment constitute the conclusion of a sales contract between the Parties and acceptance of the General Terms and Conditions of Sale.

The Customer who has placed an order will have the possibility to print their invoice by logging in to the Site in the order tracking area provided for this purpose.

L’ENFANTIN reserves the right not to validate the order in the event of:

  • abnormal or abusive claims,
  • abnormal orders with regard to the quantities ordered,
  • abnormal or abusive exchanges and returns,
  • existing dispute(s) with the customer.

 

L’ENFANTIN customer service is available to the Customer for any questions relating to their order. Customer service is available by email (contact@lenfantin.com), and by phone at 01 47 05 22 59, Monday to Friday, from 10 am to 6 pm.

  • 3 Payment

The price of the Products purchased is payable in full on the day the order is placed by the Customer. Payment is made online by credit card (Carte Bleue, Visa, Eurocard/Mastercard/American Express) at the time the Customer validates the order.

The authorization request for card debit is made at the time of order validation on the Site, except in case of server unavailability. L’ENFANTIN reserves the right to make a new debit authorization request if the first one failed due to server unavailability.

In the event of a payment default, an incorrect address or any other problem with the Customer's account, L’ENFANTIN reserves the right to block the Customer's order until the problem is resolved.

In the event of fraudulent use of their credit card on the Site, the Customer is invited to contact L’ENFANTIN customer service at the following number: 01 47 05 22 59 from Monday to Friday from 10 am to 6 pm or by email at the following address: contact@lenfantin.com

L’ENFANT implements all necessary means to ensure the confidentiality and security of banking data transmitted on the Site. The Site is equipped with an online payment security system allowing your banking data to be encrypted. Payment information is transmitted according to the highest security standards. The transmission of your banking data is guaranteed by our partner.

All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted, or used by third parties. At no time does the Customer's financial data pass through L’ENFANTIN's computer system.

  • 4 Order Archiving

The order confirmation is recorded in L’ENFANTIN’s registers, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation be considered as proof of the contractual relationship between the Parties.

ARTICLE 5 • DELIVERY

L’ENFANTIN will deliver orders within a maximum period of twenty (20) working days for delivery to Metropolitan France, and thirty (30) working days for delivery to any other destination, starting from the day following payment of the order.

For orders outside France, when the package destined for export arrives at its destination, it will be the recipient's responsibility to pay any taxes or customs duties applicable in the destination country. Local authorities can provide useful information.

From January 1, 2021, for a package with a value exceeding €1000 destined for export to the United Kingdom, it will be the recipient's responsibility to pay the taxes or customs duties applicable in the destination country.

ARTICLE 6 • RECEIPT OF ORDER – COMPLAINTS - RETURNS

The Customer is required to check the conformity of the Products received in execution of their order at the time of delivery. Any anomaly concerning the delivery such as:

  • damaged package,
  • missing products,
  • deteriorated products,
  • products not conforming to the order,

Must be notified within the legal deadlines following receipt of the order.

This notification will be sent to L’ENFANTIN customer service either:

  • by registered mail, by writing to the following address: L’ENFANTIN – 25 Rue de l'Exposition - 75007 Paris.
  • by email to contact@lenfantin.com

After this period, and except for hidden defects, no claim will be accepted by L’ENFANTIN, the Products then being deemed compliant.

For any return of non-compliant Product, the Customer must follow the following procedure:

  • the Products must be returned either in their original packaging, or in packaging protecting the product against any deterioration, with their label and any accessories allowing their re-marketing, to the following address:

Returns of personalized products will not be accepted.

  • The risks and return costs are the sole responsibility of the Customer.

Once non-conformity has been established, L’ENFANTIN will offer the Customer a refund of the order price (price of the Products and delivery costs) as well as the return costs of the non-conforming Product, at the latest within thirty (30) days from the date of sending the notification of non-conformity confirmation by L’ENFANTIN site's customer service.
In case of refund, L’ENFANTIN will refund the totality of the conforming products, as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery. Cash on delivery returns are not accepted. Upon receipt of a non-conforming item, L’ENFANTIN will cover the refund of postal return costs up to the tariff schedule (Colissimo delivery without registered mail) displayed by La Poste on March 1st of the current year. The Customer must send proof of the incurred return costs to Customer Service by email. In case of abnormal or abusive claims, L’ENFANTIN may refuse to fulfill a subsequent order.

ARTICLE 7 • RIGHT OF WITHDRAWAL

The Customer has a period of fourteen (14) working days from the date of receipt of their order to return the ordered Products, without justification or penalty, except for personalized products.

For any return under the right of withdrawal, the following procedure must be fully respected:

  • the Products must be returned in their original packaging, with their label and any accessories, in impeccable condition to: L’ENFANTIN – 25 Rue de l'Exposition - 75007 Paris.
  • the risks and return costs are the sole responsibility of the Customer. Subject to the conditions recalled above, L’ENFANTIN will refund the total amount including tax of the order to the Customer (price of the Product and delivery costs) excluding return costs. The Customer's bank account will be credited with the said amount within thirty (30) days from the receipt of the Products by L’ENFANTIN.

 

ARTICLE 8 • PERSONAL DATA

L’ENFANTIN collects a certain amount of information necessary for processing orders.

This data is not only necessary for L’ENFANTIN to process the Customer's order, but also to communicate information about the L’ENFANTIN brand and the Site to the Customer.

The information is strictly confidential and is marked with an asterisk (*) when it is necessary for L’ENFANTIN, and/or its service providers within the framework of managing the Customer's order.

Following any injunction from legal authorities or in order to defend its rights or those of its employees, customers or any other person, L’ENFANTIN may communicate this data to legally authorized bodies and authorities.

L’ENFANTIN undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being distorted, damaged or accessed by unauthorized third parties.

The Customer's personal information is sent and stored with the site's host located in Canada, whose contact details can be found on the site under the "Legal Notice" section.

In accordance with the "Data Protection Act" of January 6, 1978, as amended by the law of August 6, 2004, the Customer benefits from a right to access, rectify, modify and delete data concerning them.

The site is declared to the Commission Nationale de l’Informatique et des Libertés - CNIL under no. 1351361. The Customer can exercise this right by sending a letter to the following address or by email, specifying their last name, first name, email, and postal address:

The Customer can also modify their personal details from their customer area by identifying themselves with their email address and password.

ARTICLE 9 • COOKIES

In order to process the Customer's order, and to better understand their needs and personalize the services offered on the Site, L’ENFANTIN uses cookies. A cookie is a computer file, stored on the hard drive of the Customer's computer, whose purpose is to indicate their visit to the Site.

Cookies remember the Customer's visit duration on the Site, their identity (known through their email address and password) and the content of their cart. Once logged out of the Site, this information is stored for 30 (thirty) days before being permanently deleted.

The Customer may object to the recording of cookies by configuring their Internet browser. They will then lose all personalization of the service offered to them on the Site.

ARTICLE 10 • LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet, particularly concerning technical performance, response times, connection, information queries or transfers, risks of interruption, risks of contamination by viruses circulating on the network, and generally all risks related to the use of the Internet.

L’ENFANTIN cannot therefore be held responsible in any way for any direct or indirect damage resulting from improper use or an incident related to the use of the computer, internet access, maintenance or malfunction of servers, the telephone line or any other technical connection, the Customer's connection to the Site being under their sole responsibility.

ARTICLE 11 • FORCE MAJEURE

L’ENFANTIN shall not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event constituting force majeure as defined by positive law.

In such a case, Customer Service will inform the Customer of the occurrence of such an event within 3 (three) clear days of its occurrence, by email.

After a period of 1 (one) month, and should the event constituting a case of force majeure persist, the order will be cancelled and, if applicable, will be refunded by L'ENFANTIN to the bank card used for the order within a maximum of 30 (thirty) days.

ARTICLE 12 • APPLICABLE LAW

Should any of the terms of these General Terms and Conditions of Sale be deemed null and void, illegal, or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale shall remain in force.

These General Terms and Conditions of Sale are executed and interpreted in accordance with French law. In the event of a dispute, the customer shall primarily contact L'ENFANTIN to seek an amicable solution, and failing an agreement, the ordinary courts shall have sole jurisdiction.
